E-commerce giant Temu is seeking to rebut a lawsuit brought by the estate of the late rapper and producer MF Doom over counterfeit goods, arguing that it should not be held legally responsible for the actions of independent Chinese sellers on its platform.
The legal representative of Temu emphasized that the company's business model clearly states that the sales rights of goods belong to independent third-party sellers in China. They argued that Temu only provides an intermediary platform, and therefore, according to the current intellectual property laws, the platform should not bear direct legal responsibility for the infringement actions of third-party sellers.
In addition, Temu mentioned that the estate management of MF Doom attempted to claim ownership of the deceased artist's portrait rights. However, according to British law, portrait rights are not recognized after death, and MF Doom passed away in the UK in 2020, which further complicates this claim.
In the legal document, Temu's lawyer stated: "Upon receiving the complaint, Temu promptly initiated an internal investigation. Based on the principle of prudence and in accordance with intellectual property policies, Temu did not admit to the validity of Gas Drawls' allegations. Instead, based on the low-quality screenshots provided by the other party, Temu proactively removed all identifiable related products.". ”
This incident has sparked significant discussions on the legal responsibilities of e-commerce platforms. In today's era where online shopping is increasingly prevalent, balancing consumer protection and platform responsibilities has become a highly controversial topic. Temu's defense not only concerns its own legal status but also provides insights for the entire e-commerce industry on how to respond in similar incidents.
